ARE YOU ELIGIBLE ?

You sold a property in France? You could be entitled to claim a french tax refund (9,70%) although you would remain liable for the solidarity tax of 7.5%.

You could claim the refund of CSG (9,20%) and CRDS(0,5%) if you have been taxed in France, but are affiliated to a social security system of another EU member state, Switzerland or UK.

More precisely, it is the case for the cross-borders commuters living in France but working in another EU member state, Switzerland or UK.

It is similar for non residents living outside France, working in another state of EU, Switzerland or UK, but having earned income in France (rent or capital gains) subject to social levies.

YES, IF YOU ARE A NON-RESIDENT :

  • You work or live in a EU member state, in Switzerland or UK and are affiliated to the social security system of this country
  • You earned income in France (rent or capital gains)

YES, IF YOU ARE A CROSS-BORDER COMMUTER :

  • You live in France
  • You work or have worked in one of the EU member states or Switzerland and are subject to the social security system of this country

 

WHAT CAN YOU RECOVER ?

You can obtain the refund of the CSG and CRDS (social security contributions levied) on your capital revenues at the following rate:

  • 9,2% for CSG
  • 0,5 % for CRDS

For example: you sold a property 400.000€ and your capital gain is 100.000 Euros, you can be refunded 9.700€ from the social contribution paid.

DELAYS ?

The delays are fixed by civil law, in particular article R.196-1 of the tax procedure book.

If the delay expires, it will be too late to claim your rights to be reimbursed.

FOR EU AND SWISS RESIDENTS

Your right to obtain a reimbursement has been confirmed by the French justice by decision dated April the16th 2019 from the Conseil d’Etat.

 

The highest French administrative court, has definitively established a right to reimbursement. 

 

The finance bill 2019 has finally adopted the abolition of the social security contribution (CSG/CRDS) with effect from 1 January 2019.

FOR UK RESIDENTS

On the basis of the Protocol on social security coordination annexed to the Trade and Cooperation Agreement signed on 24 December 2020 between the EU and the UK and which came into force on 1 January 2021, UK taxpayers who come under the NHS are entitled to claim back the CSG and CRDS they paid on their French source income.
